Mesothelioma Compensation by Type

Three forms of mesothelioma carry different compensation profiles. Pleural mesothelioma (lining of the lungs) is the most common form, accounting for around 75% of cases. Compensation typically ranges from £80,000 to £400,000 depending on age, prognosis, dependants and the strength of the work-history evidence. Peritoneal mesothelioma (lining of the abdomen) is rarer but generally carries a similar compensation range. Diagnosis is often delayed because symptoms (abdominal pain, weight loss, ascites) overlap with many other conditions — strengthening the case for full investigation of any prior misdiagnosis. Pericardial mesothelioma (lining of the heart) is the rarest form. Cases are technically complex and require specialist expert witnesses on both diagnosis and causation. In all three forms, actual compensation depends on additional factors: the date of asbestos exposure, the identity and current status of the responsible employer(s), any prior compensation already received from government schemes, and the medical evidence linking exposure to disease.

Could I claim if my exposure to asbestos was decades ago?

Yes. Mesothelioma has an unusually long latency — typically 20-50 years between exposure and diagnosis. UK law specifically allows claims to be brought from the date of diagnosis (or date of knowledge), not the date of exposure.

What if my former employer no longer exists?

You can usually still claim. Their employer’s liability insurer at the time of your exposure typically remains liable. The Employers’ Liability Tracing Office (ELTO) holds records that often allow us to identify the right insurer decades later. Where no insurer can be traced, the Diffuse Mesothelioma Payment Scheme (DMPS) provides a route to compensation specifically for mesothelioma sufferers.

How long do mesothelioma claims take?

The UK courts run an expedited “show cause” procedure for mesothelioma specifically. Most cases settle within 6 to 18 months. Interim payments can be ordered very early to cover urgent treatment and care costs while the full claim is valued.

Can I claim if I never worked directly with asbestos?

Yes, in many cases. UK courts recognise secondary (or “domestic”) exposure — for example a spouse who washed dusty overalls, or a child who hugged a returning parent. These claims are now well-established in case law.

What government compensation schemes exist?

Several schemes can pay alongside (or instead of) a civil claim: the Diffuse Mesothelioma Payment Scheme, the Pneumoconiosis (Workers Compensation) Act 1979, the 2008 Act, and Industrial Injuries Disablement Benefit. A specialist solicitor pursues these in parallel with the civil claim.

Does pursuing a claim affect my NHS care?
