Spinal Injury Compensation Claims

According to Spinal Research figures around 1,000 people in the UK and Ireland sustain a spinal cord injury each year.

Spinal injuries can be very traumatic for victims and their families as they often have lifelong implications. A spinal injury can leave a victim permanently disabled and can sometimes cause paralysis.

Apart from the physical pain a victim has to deal with, there is also the emotional trauma that a spinal injury can cause.

Back Injury & Spinal Injury Compensation

When claiming compensation for a spinal injury there is a lot that needs to be considered when looking at the amount being awarded. Apart from the pain and suffering the victim has had to endure, the compensation would also need to include:

  • Loss of earnings and future earnings
  • Rehabilitation costs
  • Nursing care
  • Disability aids
  • Specialist equipment
  • Transport costs
  • Modifications to the home and car if needed

Spinal injury victims have enough to deal with which is why Mayiclaim make the claims process as stress free as possible. We work with a range of experienced solicitors who specialise in spinal injury compensation claims.

Our nationwide solicitors also work on a no-win-no-fee basis. Therefore, if for any reason we are unsuccessful, you will not be burdened with expensive legal fees.

Levels of Spinal Cord Injury and Their Implications

Spinal cord injuries are categorised by the level of the spine at which damage occurred. The higher the injury, the greater the impact. Cervical spinal injuries (neck level — C1 to C7) typically result in tetraplegia (also called quadriplegia) — paralysis affecting all four limbs and the trunk. Injuries at C4 and above often require ventilator support and round-the-clock care. Thoracic spinal injuries (upper to mid-back — T1 to T12) usually result in paraplegia — paralysis of the lower body with full use of arms and hands. Independence levels vary depending on the precise level. Lumbar and sacral injuries (lower back — L1 to S5) affect the legs and pelvic functions, often allowing significant mobility with appropriate equipment and rehabilitation. In every case, the long-term care, equipment, accommodation, and earning capacity implications dictate the claim value — and most cases involve substantial future-loss elements.

Frequently Asked Questions

Can I claim if the injury did not happen at work?

Yes. Spinal injuries can arise from road traffic accidents, falls, sporting incidents, surgical complications, medical negligence, and many other circumstances. The claim is brought against whoever was legally responsible for the negligence — workplace, driver, surgeon, hospital, occupier, or other party.

How is spinal injury compensation calculated?

Compensation reflects pain, suffering and loss of amenity (general damages) plus all financial losses (special damages): past and future care costs, equipment, accommodation adaptations, lost earnings, pension losses, and the cost of professional case management. For severe spinal injuries, compensation often exceeds £1 million when all lifetime needs are accounted for.

What about home adaptations and accommodation?

Adapted accommodation (often a new property or major renovation of an existing one) is one of the largest single elements in spinal injury claims. An accommodation expert produces a costed report covering the property modifications or relocation needed for independent living.

How long do spinal injury claims take?

Most spinal injury claims settle within 3 to 5 years. The timeline reflects the need for the medical prognosis to stabilise (often 2 years from injury) before the claim can be valued, plus the complexity of agreeing future care and accommodation needs with the defendant’s insurer.

Will I need a deputy or trust to manage my compensation?

For severe injuries where the claimant lacks mental capacity, a Court of Protection deputyship is appointed to manage the funds. For claimants with capacity, a personal injury trust is usually the recommended structure — it protects the compensation from affecting means-tested benefits.

Can I claim for psychological impact?

Yes. Psychiatric injuries — depression, anxiety, post-traumatic stress — are recognised alongside the physical injury and form part of the general damages award. Many spinal injury claimants also recover additional sums for psychological treatment, counselling and rehabilitation support.
