What is asbestosis?

Asbestosis is a chronic lung disease caused by inhaling asbestos fibres over time. The fibres scar the lung tissue, making it stiffer and less able to take in oxygen. Typical symptoms include progressive breathlessness, a dry cough, chest tightness and reduced stamina. Diagnosis usually rests on imaging (commonly a CT scan), lung-function tests and a clear exposure history. Who typically develops asbestosis — and which trades?

Asbestosis usually follows substantial or prolonged occupational exposure. Trades most often seen include asbestos laggers, plumbers and heating engineers, shipyard and dock workers, construction and demolition operatives, electricians, joiners, boilermakers, power-station workers, and people who cut or drilled asbestos cement boards and lagging. How much is an asbestosis payout in the UK?

Provisional damages

Where your condition may worsen — or where there is a recognised risk of a more serious asbestos disease later — a claim can sometimes be settled on a provisional damages basis: damages for the current disease now, with permission to return to court if a specified deterioration (for example progression to mesothelioma) occurs. Whether that is appropriate depends on the medical evidence and how liability is admitted; it is not an automatic right.

Can you claim if the employer has closed? EL insurers and ELTO

Yes — most asbestosis claims are paid by historic employers’ liability (EL) insurers. Specialist solicitors use the Employers’ Liability Tracing Office (ELTO) and archive research to find the insurer that covered your employer at the time of exposure. A dissolved company can, where necessary, be restored to the register. Government support: 1979 Act and IIDB (and why DMPS is different)

Alongside a civil claim, Industrial Injuries Disablement Benefit (IIDB) can apply where asbestosis meets the industrial-disease rules. Where IIDB is payable (or would be) and relevant employers have ceased trading, a lump sum under the Pneumoconiosis etc. (Workers’ Compensation) Act 1979 may also be available. These routes sit parallel to a civil claim; deductions need specialist advice.

The Diffuse Mesothelioma Payment Scheme (DMPS) is for diffuse mesothelioma — not for asbestosis. It is a last-resort scheme where a mesothelioma sufferer cannot trace a negligent employer or insurer, and it does not pay for asbestosis, diffuse pleural thickening or plaques. Time limits for an asbestosis claim UK

Under the Limitation Act 1980, you generally have three years from your date of knowledge — usually when you knew, or ought reasonably to have known, that you had a significant injury linked to asbestos — to issue court proceedings. For asbestosis that is typically the diagnosis date, not the decade of exposure. Section 33 discretion exists but should never be treated as a plan.
